Abstract

Copyright protects original works of the mind, whatever their artistic merit or purpose. But what is a work of the mind ? French copyright law refers to " the imprint of the author's personality" . As AI has (at least not yet!) neither a " mind"  nor a " personality " with which it can imbue its outputs, we need to look for the human being who exercises decisive control over the outcome of the process that results in an apparently literary, musical or artistic production. AI-assisted creation can, like any other creation, involve random elements, provided that a human being masters them as a whole. This control will enable us to distinguish between an AI-assisted work (the subject of copyright) and an AI-generated production (not protectable by copyright).
